PLEASE CAREFULLY READ THE KAPattern ACADEMIC LICENSE AGREEMENT ("LICENSE") BEFORE DOWNLOADING KAPattern. BY DOWNLOADING THE KAPattern SOFTWARE, YOU ARE AGREEING TO BE BOUND BY THE TERMS OF THIS AGREEMENT. IF YOU DO NOT AGREE TO THE TERMS OF THE KAPattern SOFTWARE LICENSE, YOU ARE NOT AUTHORIZED TO DOWNLOAD THE KAPattern SOFTWARE.

KAPattern ACADEMIC SOFTWARE LICENSE 
1. GENERAL: This Agreement is made between The Medical College of Wisconsin, Inc. (hereinafter "LICENSOR"), with offices at 8701 Watertown Plank Road, Milwaukee, Wisconsin 53226, and the LICENSE. Whereas the LICENSOR owns and has copyrighted certain computer software and associated documentation known as "KAPattern". The LICENSEE desires to secure a non-exclusive license to KAPattern and LICENSOR is willing to grant such a license. The parties hereby agree as follows: 
2. LICENSE: LICENSOR hereby grants, and LICENSEE accepts, a single nontransferable and non-exclusive license to use KAPattern. KAPattern is licensed for use solely for Licensees internal applications. No rights are granted to sublicense or market KAPattern. All rights not specifically granted to LICENSEE by this license shall remain with LICENSOR. 
3. USE: KAPattern may be used by LICENSEE only for academic and non-profit research. All copyright or proprietary notices in the original must be included in any copies made by LICENSEE. LICENSEE shall not clone, reverse engineer, or reverse compile any part of KAPattern or adopt any part of KAPattern as its own. KAPattern may not be used for any commercial purpose. Should LICENSEE have a need for commercial use of KAPattern, commercial licensing is available upon making a specific request from the author and the Medical College of Wisconsin and generating a customized license agreement? 
4. TRANSFER TO THIRD PARTIES: LICENSEE acknowledges that the Software and Documentation that comprise KAPattern are proprietary products of LICENSOR and shall remain the property of LICENSOR. LICENSEE will not disclose to or otherwise make available copies of KAPattern to any third party. Third party requests for a license to KAPattern received by LICENSEE shall be referred to LICENSOR. 
5. CHARGES: LICENSOR will charge LICENSEE no fee for the non-exclusive license granted herein for academic and non-profit use. 
6. DISCLAIMER OF WARRANTIES: KAPattern is provided to LICENSEE on an "as is" basis without warrantee of any kind either express or implied. LICENSOR does not warrant as to whether the functions contained in KAPattern will meet LICENSEE'S or any end user's specific requirements or that the operation of KAPattern will be uninterrupted or error free, or that program defects, if any, can or will be corrected. LICENSOR makes no warranties, express or implied, as to the merchantability and fitness for a particular purpose or as to whether KAPattern or use thereof infringes any trademark, patent, copyright, or similar rights of any third party. 
LIMITATION OF LIABILITY: LICENSOR shall not be liable for any indirect, incidental or consequential damages such as, but not limited to, loss of anticipated profit, savings or benefits. LICENSOR shall have no liability for any claim of any kind arising in connection with any use or other employment of KAPattern. 
TERMINATION: This License Agreement can be terminated by LICENSOR or LICENSEE on thirty (30) days notice for any reason. If this Agreement is terminated, the license granted hereunder shall be terminated, LICENSEE'S right to use KAPattern shall end immediately, and LICENSEE shall return or destroy all copies of software and documentation which is KAPattern. 
NOTICES: All notices, consents, and other communications related to this License Agreement shall be sent to the parties at their respective addresses as set forth below. Notices to LICENSOR shall be addressed to:
